These Terms of Service (“Terms”) are a legal agreement between you and Ellis marketing of Texas LLC dba Evergreen Drops (“we,” “us,” or “our”), located at 8985 Vantage Point Dr 1009, Dallas, TX 75243. By signing up, accessing, or using the Evergreen Drops marketing kit (the “Service”), you agree to these Terms. If you do not agree, please do not use the Service.
1. About the Service
Evergreen Drops is a guided marketing studio that helps you plan social posts, generate images and short videos, research keywords and backlinks, write blogs, build landing pages, and track what is working. The Service produces drafts and suggestions; you remain responsible for reviewing, approving, and publishing anything that represents your business.
2. Accounts and eligibility
To use the Service, you must create an account with a valid email address and keep your password secure. You must be at least 18 years old, or have permission from a parent or guardian if required by law. You are responsible for everything that happens under your account.
3. Acceptable use
You agree to use the Service lawfully and respectfully. You must not:
- Use the Service for illegal, fraudulent, or harmful purposes.
- Send spam, phishing messages, or malware.
- Infringe anyone’s intellectual property, privacy, or other rights.
- Attempt to interfere with the Service’s security, performance, or availability.
- Scrape, reverse engineer, or copy the Service without permission.
- Use the Service to generate or distribute hate speech, harassment, or explicit content.
4. Intellectual property
We own the Service, its code, designs, branding, and documentation. You own the content you input and the final outputs you create for your business. We grant you a limited, non-exclusive, non-transferable right to use the Service during your active account period.
5. Payments, billing, and Paddle Merchant of Record
Payments for the full version of the Service are processed by Paddle, our online reseller and Merchant of Record. This means:
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
By purchasing, you agree to Paddle’s Buyer Terms. Prices are listed in US dollars and are one-time unless otherwise stated. You are responsible for any taxes required by your jurisdiction.
6. Refunds
We offer a 30-day money-back guarantee. If you are not satisfied with your purchase, you may request a full refund within 30 days of your order date. Refunds are processed by Paddle. You can request a refund by emailing support@evergreendrops.com or visiting paddle.net. Eligible refunds are returned to the original payment method within 3–5 business days.
7. Service level
We work hard to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free performance. The Service may occasionally be unavailable for maintenance, updates, or reasons beyond our control.
8. Termination and suspension
We may suspend or terminate your access if you materially breach these Terms, fail to pay when due, pose a security or fraud risk, or repeatedly violate our policies. You may stop using the Service or delete your account at any time.
9. Warranties and liability
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all implied warranties. Our total liability is limited to the amount you paid us in the 12 months before the claim, except where liability cannot be limited by law (such as fraud, death, or personal injury).
10. Governing law
These Terms are governed by the laws of Texas, United States. Any disputes will be resolved in the courts of that jurisdiction.
11. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes means you accept the updated Terms.
